It’s one of the first questions homeowners ask before starting a retaining wall project: do I actually need a permit for this? The short answer is that it depends on the wall’s height, what it’s supporting, and how close it sits to a boundary — and the exact requirements are set by your local council, not by us, so this guide covers the general principles rather than a specific number you can rely on for every site.
Why Height Isn’t the Only Factor
Most Victorian councils base retaining wall permit requirements on the Building Regulations, and height is the most commonly cited trigger — but it’s rarely the only one. A wall’s permit status can also depend on:
- Surcharge loads — whether the wall supports a driveway, structure, or other load above it, rather than just holding back garden soil.
- Proximity to a boundary — walls built close to or on a boundary line often face stricter requirements than walls set well within a property.
- Proximity to existing structures — a wall near an existing house, garage or easement can trigger additional engineering and approval requirements regardless of its height.
- Site conditions — sloping or reactive-clay sites (common across much of Melbourne’s growth corridors) can require engineering sign-off even for a wall that might otherwise be exempt.
Our General Rule of Thumb
As a starting point, taller retaining walls (broadly, walls over around one metre) and any wall supporting a surcharge load are the ones most likely to need a permit and engineering design. Shorter garden-variety walls holding back nothing but soil are more often exempt — but “more often” isn’t the same as “always,” and getting this wrong can mean an expensive rebuild if council later requires it to be brought up to standard.
